Hotel Vista Hermosa Salento

This document sets out the General Terms and Conditions and the House Rules that govern the booking, the contracting of accommodation services and the stay at Hotel Vista Hermosa Salento (hereinafter, "The Hotel"). By making a booking, entering our premises or using our website, you acquire the status of "Guest" or "User" and expressly accept, freely and without reservation, each and every one of the clauses set out herein.

1. Legal Capacity and Mandatory Registration

To contract the services of The Hotel, the User must be of legal age (18 years) under Colombian law and have sufficient legal capacity to enter into a contract.

In accordance with Article 22 of Law 2068 of 2020 (Colombia's Tourism Law), every person entering the hotel is required to complete the digital or physical Hotel Registration Card (TRH). Every Guest, whether Colombian or foreign, must show a valid original identity document (Colombian ID card, Foreigner ID card or Passport with the corresponding entry stamp).

2. Rates, Taxes and Payment Guarantees

• Rate Policies: The prices published on our website are subject to change depending on the season, occupancy and current promotions. Rates are formally confirmed when the booking process is completed.
• Taxes (VAT): Under Colombian tax regulations, accommodation rates are subject to Value Added Tax (VAT) applicable to residents of the country. Non-resident foreigners who meet the legal requirements for tax exemption (tourism stamp from Migración Colombia) are exempt from this tax on the basic accommodation service only.
• Security Deposit: The Hotel reserves the right to request a credit card as guarantee or a cash deposit at Check-in to cover possible additional charges, complementary services or unforeseen damage.

3. Modification, Cancellation and "No Show" Policies

The Hotel offers different types of rates whose specific cancellation conditions are detailed at the time of purchase:

• Flexible Rates: Allow cancellation or modification without penalty up to forty-eight (48) hours before the scheduled check-in date. Cancellations made after this period will incur a charge equal to the first night of the stay plus taxes.
• Non-Refundable Rates: Do not allow cancellations, refunds or date changes. If the Guest withdraws, the total amount charged will be final.
• No Show Condition: If the Guest does not arrive at The Hotel before 11:59 PM on the scheduled check-in day, without prior written notice, the booking will be considered automatically cancelled and 100% of the first night or of the entire stay will be charged, depending on the specific conditions of the rate booked.

4. Operating Hours (Check-in and Check-out)

• Check-in (Arrival Time): Formally set from 15:00 (3:00 PM). Early Check-in is strictly subject to room availability on the day of arrival and may incur additional charges set by management.
• Check-out (Departure Time): Formally set until 12:00 (12:00 PM). The Guest must hand over the room in good condition and return the keys or access cards. Late Check-out after the set time, without prior written authorization from reception, will incur a penalty equal to 50% of the room's daily rate, and 100% if it goes beyond 15:00.

5. Coexistence Rules and House Regulations

To safeguard the peace and safety of our whole community, the Guest agrees to respect the following rules:

1. Quiet and Rest Hours: A mandatory period of absolute silence is established between 22:00 (10:00 PM) and 07:00 (7:00 AM). The use of speakers, musical instruments or loud devices that disturb other guests' rest is prohibited.
2. Smoke-Free Policy (100% Tobacco-Free Spaces): In strict compliance with Resolution 1956 of 2008 of the Ministry of Social Protection, it is strictly forbidden to smoke traditional cigarettes or cigars, or to use electronic cigarettes or vaporizers inside the rooms, balconies and enclosed common areas of The Hotel. Failure to comply with this rule will result in an automatic financial penalty of $150 USD (or its equivalent in Colombian pesos) to cover the costs of deep cleaning and textile deodorizing of the room.
3. Visitors and Unregistered Guests: For security and immigration-control reasons, people who are not part of the original booking are not allowed into the room areas without express authorization from reception. Every visitor must register at the front desk with their identity document.

7. Liability for Damage, Deterioration and Missing Items

The Guest who holds the booking will be directly and jointly liable for material damage, breakages, permanent stains or missing items affecting the infrastructure, furniture, linen (sheets and towels) or decoration of the room or common areas, whether caused by carelessness, intent or negligence on their part or that of their companions. The Hotel will assess the replacement value of the affected items and the corresponding charge will be made automatically to the guarantee credit card or to the deposit balance.

8. Safekeeping of Valuables and Limitation of Liability

The Hotel has security systems and safes in the rooms for the safekeeping of personal valuables, cash, passports, jewelry or electronic devices.

In accordance with the Colombian Civil Code, The Hotel **will not assume any liability** for the loss, misplacement or damage of valuables, money or other property that has not been formally deposited under documented custody in the main office safe, nor for events arising from force majeure, unforeseeable circumstances or the Guest's own negligence.

9. Environmental and Sustainability Policy

Hotel Vista Hermosa Salento operates under strict principles of sustainable tourism and ecological conservation of the Coffee Cultural Landscape. The Guest agrees to make rational, moderate and conscious use of drinking water and electricity. Likewise, bringing in, trading or possessing protected wild flora and fauna is strictly prohibited (Law 1333 of 2009).

10. Jurisdiction and Applicable Law

This contract is governed entirely by the laws of the Republic of Colombia. Any dispute, disagreement or claim arising from the fulfilment, interpretation or execution of these terms and conditions will be submitted to the competent judges of the Colombian jurisdiction, with the city of Armenia, Quindío, established as the legal and contractual domicile.
